Federal Litigation

 

Criminal Cases. When pleading guilty is not an option, Nick is available to identify promising litigation strategies and to prepare clients meticulously for trials. Nick has tried cases to verdict and obtained acquittals in federal white-collar criminal jury trials. Much of Nick’s work involves defending healthcare providers and businesses accused of fraud, kickbacks, Medicare Fraud, and telemedicine violations. Additionally, Nick resolved a great number of conspiracy cases, Controlled Substances Act matters, mail fraud, wire fraud, money laundering, bitcoin and cryptocurrency cases, bribery, corruption, investor fraud, insider trading, tax fraud, bank fraud, Covid-19, PPP loan, and computer offenses.

 

Civil Cases. Nick set his first federal precedent when he convinced a federal judge to break with 70 years of established practice in the early stage of private practice and redefined the subpoena authority of attorneys under Rule 45 Federal Rules of Civil Procedure. In that case alone, Nick quashed 14 federal subpoenas since Nick has ensured that his CEO, CFO, and business owner clients do not suffer civil liabilities in civil government cases (e.g., False Claims Act) or private litigation proceedings (e.g., employer defense).

 

Accolades

Nick has written several widely published books, articles, and blogs and taught constitutional law and federal civil procedure on four continents. Nick’s Ph.D. thesis, a critical analysis of constitutional interpretation, was personally enriched by U.S. Supreme Court Justice Stephen Breyer, the Chief Justice of Brazil, and others.
